AnyMusic Team, I note that on your product pages FAQ section you have the question:

"Is it safe and legal to download music with AnyMusic?"

Oddly you are not open and forthright in your answer!

You state:

"It's safe to download music with AnyMusic, but all music from AnyMusic is from the internet, you take responsability for the content you download. AnyMusic is only a handy music tool."

So is it really safe? Could you be prosicuted and fined and if you don't pay the fine imposed by a court find yourself subjected to a custodial sentence? Is just about every piece of music published on the internet potentially subject to copyright license and potential civil and criminal legal ramifications? Or at least risk the banning of your access to a given service for breach of their terms of use? Come on be open and honest up front and let people know that "you take responsability for the content you download." really means "you are responsible for complying with the EULA/Distribution terms of service and copyright licenses and if you breach them and get prosicuted or banned from further access it's your responsability."

Or the simple answer to the question:

"Is it safe and legal to download music with AnyMusic?"

While AnyMusic itself does nothing to add any risk to the process of streaming music content from the internet criminals are always looking for ways to infect and exploit underlying bugs found in media processing software like codecs etc so it is possible that content may have been designed to be malicious and AnyMusic cannot know about or protect you from such malicious content.
Regarding the legality of downloading music off the internet for offline use or use in other devices not catered to by the free service. Most creative content on the internet is covered by Copyright laws and treaties and various end user license. It is the end users responsability to discover and abide by those laws that apply in addition some services specifically prohibit in their terms of service the use of 3rd party software to abuse the streaming technology to obtain unlicensed personal coppies of the content and may result in user accounts being banned and or civil legal action for costs incured by the service in complying with the usage licenses they have purchassed from the copyrights holders."

i.e. It is not clear cut and the risks could be significant, you may get away with it or you may lose your liberty or suffer some consiquence between the two extremes!

TK, TK, I'm not sure what your point is TK; as they state it is your responsibility to make sure the music you download is safe. They just provide a tool to search for and download said music. I've never used the software, but it sounds to me like a good tool to find music you're looking for. You can't expect everyone to do everything, for you or anyone else. This is not opinion, it is just a fact of life. I'd say by posting the disclaimer they've covered themselves from impunity.

Reply   |   Comment by JonE  –  9 months ago  –  Did you find this comment useful? yes | no (+1)

TK, I'd say their disclaimer is right on and I'm pretty sure their disclaimer protects them from any impunity.

[ TK ],

Get off it, all countries signed to the Berne copyright treaties obey the US Supreme Court's decision that home recording for personal use ( "timeshifting" ) of anything that arrives into your home is not a violation of copyrights, see the Sony Betamax case of ... wait for it ... 1984, oh my!

JonE, please RE-READ it was NOT a legal disclaimer but suposedly an answer to a frequently asked question. Also most bpoilerplate website disclaimers have no legal standing and are not even legally valid.

JonE, I know it may be difficult to comprehend English if it's not your first language but the basic FACT or TRUTH even is everything you do or choose NOT to do is your responsability. Stating it does not answer the question of legality, with regard to Copyright law OR contractual law which seems to confuse alot of people. At least two sets of laws are involved with regard to ripping the sound tracks of copyright media offered solely for on demand streaming on services such as Spotify, Youtube, Netflix, BBC iPlayer and so on.
Copyright law has moved on significantly from ancient and obsoleted court judgments back in 1984 many of the loop-holes and exceptions that were comonly regarded as "fair use" became null and voided by newer more comprehensive legislation such as the Digital Melenium Copyrights Act that prohibits specifically circumventing any form of DRM system. Even if the DRM is just NOT providing a download service for offline replay for scheduled or on demand streamed content is a type of DRM. That is current restriction covered by USA copyright legislation, UK and EUROPE have our own brand of updated legislation that is far tighter than the old copyright, designs and patents act 1988 and just recently EU directives on copyrights has changed again increasing breadth of the restrictions too.
With regard to contractual law EVERY internet service has some kind of Acceptable use policy or Terms of Service and in many cases they specifically deny the viewer the right to download and reuse content without explicit permission whether it be content copyright based or ad revenue deprivation prevention or automated file leaching stealing bandwidth from legitimate intended user activity. Often downloaders will saturate the download channel avaialble to them where as a streaming player will moderate its download speed to use just enough bandwidth to play the content without repeated buffering.

I expect websites publishing a Frequently Asked Question either ANSWER it or sate we can't answer that without providing legal amunition for content rights owners and their agents seeking to protect and control their distribution rights.

When driving down the road perfectly legally you are responsible for your actions. If an accident occours and it is your fault in some way then you are responsible, you may not have done anything prohibited by law but you are still legally responsible for any damage caused... or conversely you see someone have an accident and you stop and put your hazard warning lights on and provide first-aid and call the emergency services you are responsible for your action there too in potentially saving a life and may receive a citizens award for valour or some such... declaring you are responsible for your actions means NOTHING in terms of the questions of safety or legality or even desirability of any given action!

TK, Apparently I misunderstood a lot. I'll back out of this one. I'm and old geezer and generally pay for whatever I use and don't fully understand all the new laws for all the new stuff. I also was not aware that all my comments went through. Let's see if this does.

JonE, Please excuse the repeated posts recent changes to the coding of these webpages to try and protect their service from malicious vote manipulation attacks have rendered it almost impossible to know if a comment post has been successful or not since the page stalls on submission getting stuck in the animated "gear" like graphic

Very confused, downloaded & using their link to register for lifetime usage. comes up as a 12 months fee licence. Program is showing 14 days free trial. Did as instructed with no change to 14 day trial ... it will be interesting if this still applies.
I eventually found the folder that it downloaded too in my videos folder (Amoyshare) more by chance than any direction. My opinion is, it is a very complicated piece of software Download button option says no video available for download ?

Tried to register but got the message that my email address had already been registered. Tried to recover my password but the promised email never arrived. Set up a brand new email address and got the same message. Tried to contact customer support but still haven't received any response from them. lost interest in this software and in this company, if that's the best they can do then no thanks Another useless GOTD offering.

TK: I tried and tried and tried to reply to your post, but for some reason it just went round and round and round and never posted. In any case, Not Clear? Com'On TK what do you expect a piece of software to do for you; Everything? I'd say their disclaimer is self explanatory and protects them from any impunity. If your saying you want it to make sure the music itself doesn't contain unwanted data then again; Com'On Man.

To AmoyShare IF for any reason your site becomes inaccessible will the program lose its licensed functionality? So if I buy a lifetime membership and later on you cease trading for some reason do I lose licensed functionality? Is there ANY situation whereby you would revoke a lifetime membership/license or a subscription membership/license? If your company were prosicuted under DMCA or other future copyright laws or services take a civil action agaisnt your company and you lose the case and are compelled by court order to shut down your servers will all licenses then suddenly become invalidated?

Reply   |   Comment by TK  –  9 months ago  –  Did you find this comment useful? yes | no (+4)

Remember the true purpose of this site is to get those of us you impress with your product to potentially become your marketing department of thousands of networked individuals, not to try and manipulate us into buying a license.

The former increases your potential exposure exponentially the latter, what you have chosen, is just a potential few percent upsell to the visitors of the site just today.
