To date there have been lots of false positives - but nothing proven. While it is certainly possible that something could slip through - GOTD team has said that they do check all the giveaways. The file probably would not delete because another process currently had the file open. There's a free program called Audacity that will do this, provided your phone will take a standard format, like mp3. It's great for a lot of other things too. It doesn't take a lot of learning to open a file, cut a piece out of it, and rename that bit whatever you want. I guess essentially that's what Ringtone Maker does, so I have to wonder why it's authors consider it so special.
