ACMA warns McDonald's for Happy Meals with side of spam

Summary: Fast-food giant McDonald's has been given a formal warning by the Australian media regulator for a Happy Meal email marketing campaign.

Fast-food giant McDonald's has been given a ticking off after launching an email marketing campaign that's aimed at children.

The company posted a "send to a friend" facility on its Happy Meal website last year, which encouraged visitors to email links for McDonald's-themed games to their friends.

The Australian Communications and Media Authority (ACMA) ruled that the marketing campaign contravened the Spam Act 2003, because recipients didn't consent to receiving the emails, and they couldn't unsubscribe.

The Spam Act states that it is illegal to send, or cause to be sent, unsolicited commercial electronic messages.

McDonald's removed the link in February, and on Tuesday was given a formal warning by the ACMA.

"A formal warning is a fairly stern thing, particularly for a company the size of McDonald's," the ACMA's anti-spam manager Julia Cornwell-McKean told AAP.

The ACMA warned companies running similar marketing campaigns, which are found to contravene spam laws, that they could face tougher punishments in future.

You know, this is actually funny. I hadn't done any social networking type apps other than Twitter until recently. And with Twitter I primarily use it for following companies or news sources, I rarely ever tweet. So recently a co-worker sent me an invite to join LinkedIn. I thought that since this is geared toward the workforce I would go ahead and join. Well I receive emails every day from LinkedIn and sometimes multiple emails every day. Mostly the emails refer to job listings which I have no interest in. So in a way I can see why some email programs would consider this spam, just based on the sheer volume of emails LinkedIn sends out.I did get the email about resetting my password after being a member for only a couple of weeks. Thought it was kind of strange and maybe even bogus. I just ignored it. To be honest, I find LinkedIn to be a waste of time and bandwidth. Just another way to sell ads.

LinkedIn user alerts mistakenly blocked as spam

Researcher says more than 4% of intended recipients blocked LinkedIn's email instructions on resetting breached passwords
Many of the LinkedIn emails alerts instructing users on how to reset passwords accessed by hackers were dumped into spam boxes, according to email security vendor Cloudmark.
In a blog post on Tuesday. Andrew Conway, a Cloudmark researcher, said a substantial increase in spam reports last weekend were traced to LinkedIn password reset email alerts

In many cases, the emails that users' marked as spam were legitimate alerts from LinkedIn, Conway said.

"Over 4% of the people receiving this email thought it was spam and sent it straight to the bit bucket," Conway said. "If Linkedin sends out 6.5 million emails, then a quarter of a million people are congratulating themselves on avoiding spam -- and still have a compromised Linkedin password."

Comparative test did not take false positives into account.

Researchers from Cascade Insights performed a comparative spam filtering test on the three major webmail providers and concluded that Hotmail performed best, shortly followed by Gmail, with Yahoo! a distant third.
